Terms and conditions
Welcome to Eton Auctions. These terms and conditions govern the use of our website and the buying and selling of lots through our platform. By accessing this website or registering to bid you accept these terms in full.
1. Intellectual property rights
Unless otherwise stated, we or our licensors own the intellectual property rights in the website and material on the website, including catalogue text and photography. All these rights are reserved.
2. Licence to use the website
You may view, download for caching purposes only, and print pages from the website for your own personal use, subject to the restrictions set out in these terms. You must not republish, sell, rent or sub-license material from this website, reproduce or exploit it for a commercial purpose, or edit or otherwise modify any material on the website.
3. Bidding and buying
- All bids placed through the website are binding offers to purchase the lot at the amount bid.
- A buyer’s premium, published on each sale page, is added to the hammer price together with any applicable VAT.
- Bids placed within the final two minutes of a lot extend that lot’s closing time by two minutes.
- We may, at our discretion, refuse or withdraw any bid, withdraw any lot, and resolve disputes between bidders.
- Invoices are payable within seven days of the sale. Title passes on payment in full.
4. Authenticity guarantee
If within five years of the sale a lot is shown to be a forgery — that is, an imitation made with intent to deceive as to authorship, origin, date, age, period, culture or source — we will refund the purchase price on return of the lot in the condition in which it was sold, subject to the conditions set out in our full conditions of sale.
5. Selling
Consignment terms, including seller’s commission, reserves and settlement, are agreed in writing before a work is offered. Settlement is made 35 days after the sale provided the buyer has paid in full.
6. Limitations of liability
We will not be liable to you in relation to the contents of, or use of, this website for any indirect, special or consequential loss; or for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.
7. Indemnity
You indemnify us against any losses, damages, costs, liabilities and expenses (including legal expenses) incurred by us arising out of any breach by you of these terms.
8. Governing law and jurisdiction
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
9. Changes to these terms
We may modify these terms at any time. If a revision is material we will try to provide at least seven days’ notice before new terms take effect.
